Terms of use

One Great Gift  lets people group together to fund a special gift.  One Great Gift is a wholly owned subsidiary of Memorial Gifting Limited.

When the gift target is successfully reached or exceeded the funding goal, the total amount raised by the contributions of the supporters is passed on to the organiser/creator (used interchangeably) of the gift or the gift supplier, minus the percentage due to One Great Gift and tariffs charged by our credit card gateway, Payment Express.

If, for whatever reason, the gift target doesn’t reach its funding goal, the committed funding intended for the gift does not get charged to the supporters of the gift.

One Great Gift only approaches gift creators and pledgers or supporters of gifts. We don’t generate employment relationships, employment, association or partnership between the users and One Great Gift.

One Great Gift is responsible for the proper operation of the website, but we don’t guarantee that gifts will be executed, exempting itself from liability in this respect, with what gift creators and supporters agree expressly. Gift creators and supporters should settle any issues directly among themselves.

Definitions

A gift creator is the user of One Great Gift interested in raising funds for a gift. It’s their role to:

  • Describe the gift they want to raise funds for, which must necessarily be lawful and in accordance with New Zealand legislation;
  • Set the value they want to fund the gift;
  • Set the time within which they want to get the full amount intended to finance the gift.

A supporter or pledger is the user of One Great Gift interested in funding gifts by financially contributing to the gifts they are interested in supporting. It’s their role to:

  • Choose the gift they want to support;
  • Set the value they want to contribute to the gift;
  • Define the size of their financial contribution to this gift

One Great Gift uses registration information from Facebook or you can directly join One Great Gift. The account access may be done by entering the username and password in the login fields on Facebook, Google or One Great Gift.

The user is solely responsible for the security of their username and password. It is through this data that the user can access and change their personal information and other data from their registration.

If there is any suspected misuse or unauthorised use of your account, immediately notify One Great Gift by email to info@onegreatgift.co.nz.

One Great Gift will never use your registration information to conduct any illegal activities.

Fees and Payments

All funds raised for gifts require the use of a credit or debit card through the credit card gateway Payment Express.

All the pledge details will be held till the gift reaches its deadline. There are two possibilities when a gift reaches its deadline:

  • If the gift is successful, the total amount collected will be transferred from the account held by One Great Gift to the account of the gift creator, less 5% due to One Great Gift by its service and 3% for fees charged by our payment system per transaction. If we encounter any declined payments (eg. insufficient funds on card) we will seek to capture these pledges within 7 days of your gift closing.
  • If the gift doesn’t meet its funding criteria, all the transactions are cancelled and neither One Great Gift or Payment Express charges apply.

Unless otherwise specified, all rates are quoted in New Zealand Dollars (NZ$). The user is responsible for paying all fees and taxes associated with the use of One Great Gift. If a gift is withdrawn from One Great Gift for violating our Terms of Use, violation of law or by court order, all the supporting pledges’ will be cancelled.

Please note that Payment Express and One Great Gift are independent, and One Great Gift gives no warranty in respect of payments processed by Payment Express and is not responsible for failures of credit cards.

Delivery

Delivery will normally be made within 3 to 7 working days of the funds being received in our bank account from Payment Express. You should also allow 3 working days for the direct credit from our bank account to show in your bank account. Payments will only be made to a New Zealand bank account however where the gift is a voucher this can be sent electronically to an overseas email address.

Intellectual property

One Great Gift owns the intellectual property rights relating to its own service, which are protected by New Zealand law and international treaties. The rights of One Great Gift do not include any rights related to content created by users and displayed in One Great Gift.

The gift creator is the holder of intellectual property rights of their own gift including copyright related laws. However, all gift creators should be aware that by trying to raise funds for gifts publicly, the idea could be developed and copied by others. One Great Gift cannot prevent this from occurring, nor has responsibility for this situation. One Great Gift reserves the right at its sole discretion, and as notified, to cancel gifts and terminate the accounts of gift creators that violate intellectual property rights of others or violate other rights guaranteed by New Zealand law.

One Great Gift allows users to publish gifts and reviews without prior review or monitoring and is not responsible for the content generated by its users, nor has any obligation to monitor such content.

One Great Gift reserves the right to remove content or refuse to serve any content to users. One Great Gift also reserves the right to access, read, preserve, and disclose any information necessary to fulfil this contract, comply with laws or respond to court orders.

Privacy and security

We do all we can to provide you with the best service possible, we take your privacy and security seriously and would never supply your information to a third party. We avoid keeping any data that isn’t absolutely required.

All credit card information is fully maintained by Payment Express, a PCI compliant.This means Payment Express must fulfill all credit card security requirements. It also means that One Great Gift has absolutely no access to this information, we rely on Payment Express to confirm whether your pledge was approved or not.

For ease of use we recommend using your Facebook account or Google account to connect with One Great Gift, especially if you are creating a gift page. There are a few reasons for using your these login accounts.

  1. As a social network tool, Facebook is great for promoting your gift and will improve its visibility.
  2. You don’t need to worry about keeping several passwords.
  3. By using an integrated login your password information is secure.
  4. You will only need a brief One Great Gift profile description if you already have a Facebook profile.

One Great Gift reserves the right to change its privacy policy at any time. All updates are sent via email if you choose to accept communication via email. If there is anything else you want to know about our privacy or security conditions, feel free to drop us a line at info@onegreatgift.co.nz .

Email

One Great Gift will only send you email related to your pledges, or if there are updates to our terms and conditions. We will also email you if you have signed up for our newsletter. If you are a gift creator we notify you when a pledge is received, and to update you on your gift.

Cancellation Policy

One Great Gift reserves the right to terminate any campaign at any stage for any reason.

Please contact One Great Gift if you would like to terminate your campaign or cancel your pledge (before the gift has closed) at info@onegreatgift.co.nz .

Refund / Return Policy

One Great Gift does not offer refunds once a pledge has been processed. A Gift Creator is not required to grant a Backer’s request for a refund unless the Gift Creator is unable or unwilling to fulfill the reward.

OGG Go Getter Policy

The OGG Go Getter success fee will only be paid for successful campaigns.

Only one registered OGG Go Getter shall receive payment for any one campaign. No OGG Go Getter payment will be made to any campaign with more than one OGG Go Getter code attributed to it.

One Great Gift reserves the right to terminate the rights of a registered OGG Go Getter at any time for any reason.

Funeral Donations Policy

For donations made to charities the email address of the donor and the amount donated will be forwarded to the charity and to the person acting for the family of the deceased in order for them to contact the donor on matters relating to donation.
